ARTICLE 1 – SCOPE OF APPLICATION
These General Terms and Conditions of Sale (hereinafter referred to as "GTC") apply, without restriction or reservation, to all sales concluded by the Seller with non-professional buyers ("The Customers" or "The Customer"), wishing to acquire the products offered for sale ("The Products") by the Seller on the website www.minug.net.
The products offered for sale on the site are as follows: Clothing, perfumes, fashion accessories, siwaks, shoes .
The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity, are presented on the website www.minug.net, which the customer is required to review before ordering. The choice and purchase of a Product are the sole responsibility of the Customer. Product offers are subject to availability, as indicated when the order is placed.
These Terms and Conditions are accessible at any time on the website www.minug.net and shall prevail over any other document. The Customer declares having read and accepted these Terms and Conditions by checking the box provided for this purpose before proceeding with the online ordering process on the website www.minug.net. Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

The products presented on the website www.minug.net are offered for sale in the following territories: Worldwide . For orders shipped to countries other than mainland France, the customer is considered the importer of the product(s). For all products shipped outside the European Union and French overseas departments and territories (DOM-TOM), the price will be automatically calculated excluding taxes on the invoice. Customs duties, other local taxes, import duties, or state taxes may be applicable. These are the sole responsibility of the customer.
ARTICLE 2 – PRICE
The Products are supplied at the prices in effect on the website www.minug.net, at the time the order is registered by the Seller.
Prices are expressed in Euros, excluding and including VAT. Prices take into account any discounts offered by the Seller on the website www.minug.net. These prices are fixed and non-negotiable during their period of validity, but the Seller reserves the right to change prices at any time outside of this period. Prices do not include processing, shipping, transport, and delivery fees, which are charged separately, under the conditions indicated on the website and calculated before the order is placed. The payment requested from the Customer corresponds to the total amount of the purchase, including these fees. An invoice is issued by the Seller and given to the Customer upon delivery of the ordered Products.
ARTICLE 3 – ORDERS
It is the Customer's responsibility to select the Products they wish to order on the website www.minug.net, according to the following procedure: The customer chooses a product and adds it to their shopping cart. They can then remove or modify the product before confirming their order and accepting these terms and conditions of sale. Next, they enter their contact information and choose the delivery method. After the information is confirmed, the order will be considered final and will require payment from the customer according to the stipulated terms.
Product offers are valid as long as they are visible on the website, subject to availability. The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to verify the accuracy of the order and to report any errors immediately.
Any order placed on the website www.minug.net constitutes a distance contract between the Customer and the Seller. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute concerning payment for a previous order. The Customer can track the progress of their order on the website.
Any cancellation of the order by the Customer after its acceptance by the Seller will only be possible when the shipment has not taken place (regardless of the provisions relating to the application or not of the legal right of withdrawal).
ARTICLE 4 – PAYMENT TERMS
The price is paid via secure payment, according to the following terms:
The price is payable in full by the Customer on the day the order is placed. Payment data is exchanged in encrypted form using the protocol defined by the approved payment provider handling the banking transactions on the website www.minug.net. Payments made by the Customer will only be considered final after the Seller has effectively received the full amount due. The Seller will not be obligated to deliver the Products ordered by the Customer if the Customer does not pay the full price under the conditions stated above.
ARTICLE 5 – DELIVERIES
The Products ordered by the Customer will be delivered within mainland France or internationally. Deliveries will be made according to the delivery times announced by the carriers.
Mondial Relay announces delivery in three to five days and Colissimo announces delivery in two days to the address indicated by the Customer when placing their order on the website.
Delivery is constituted by the transfer to the Customer of physical possession or control of the Product. Except in special circumstances or in the event of unavailability of one or more Products, the Products ordered will be delivered in a single shipment. The Seller undertakes to make its best efforts to deliver the Products ordered by the Customer within the aforementioned timeframes.
If the ordered Products have not been delivered within twenty-one days of the estimated delivery date, for any reason other than force majeure, the Customer's own actions, or the carrier's actions, the sale may be cancelled at the Customer's written request, in accordance with Articles L216-2, L216-3, and L241-4 of the French Consumer Code. The sums paid by the Customer will then be refunded within fourteen days of the date of cancellation, without any deduction or compensation. Deliveries are handled by an independent carrier to the address provided by the Customer when placing the order, provided that the carrier has easy access to this address.
Delivery is deemed complete upon the Seller's handover of the ordered Products to the carrier, who must accept them without reservation. The Customer therefore acknowledges that the carrier is responsible for delivery and has no recourse against the Seller for any failure to deliver the transported goods. Should the Customer request specific packaging or transport conditions for the ordered products, and this request is duly accepted in writing by the Seller, the associated costs will be subject to a separate, additional invoice, based on a quote previously accepted in writing by the Customer.
The Customer is required to check the condition of the delivered products. They have 14 days from the date of delivery to submit any claims by , accompanied by all supporting documentation (including photos). After this period, and if these formalities have not been observed, the Products will be deemed compliant and free from any apparent defects, and no claim will be validly accepted by the Seller.
The Seller will reimburse or replace, as soon as possible and at its own expense, any Products delivered whose non-conformity or apparent or hidden defects have been duly proven by the Customer, under the conditions stipulated in Articles L 217-4 et seq. of the French Consumer Code and those stipulated in these General Terms and Conditions of Sale. All steps related to delivery are the responsibility of the Customer.
Returns and any order not collected and returned to the sender will not be eligible for a refund of delivery costs, including any applicable fees.
ARTICLE 6 – TRANSFER OF OWNERSHIP
Ownership of the Products will only transfer from the Seller to the Customer after full payment of the price by the latter, regardless of the delivery date of said Products.
ARTICLE 7 – RIGHT OF WITHDRAWAL
According to the terms of Article L221-18 of the Consumer Code, "For contracts providing for the regular delivery of goods over a defined period, the period runs from the receipt of the first good."
The right of withdrawal, except for stipulated exceptions, can be exercised by to [email protected] , which is unambiguous and expresses the intention to withdraw.
Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) allowing them to be resold as new, and must be accompanied by the purchase invoice. Damaged, soiled, or incomplete products will not be accepted. Return shipping costs are the responsibility of the customer.
The exchange (subject to availability) or refund will be made within 14 days of the Seller's receipt of the Products returned by the Customer under the conditions set out in this article.
ARTICLE 8 – SELLER'S LIABILITY – WARRANTIES
The Products supplied by the Seller benefit from:
- of the legal guarantee of conformity, for defective, damaged or faulty Products or Products that do not correspond to the order
- of the legal guarantee against hidden defects arising from a defect in material, design or manufacturing affecting the delivered products and rendering them unfit for use.
Provisions relating to legal guarantees:
- Article L217-4 of the Consumer Code: "The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision."
- Article L217-5 of the Consumer Code: "The goods conform to the contract:
1° If it is suitable for the purpose usually expected of similar goods and, where applicable:
– if it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;
– if it possesses the qualities that a buyer can legitimately expect, having regard to the public statements made by the seller, the producer or their representative, particularly in advertising or labelling;
2° Or if it possesses the characteristics defined by mutual agreement between the parties or is suitable for any special purpose sought by the buyer, which has been brought to the seller's attention and accepted by the latter. - Article L217-12 of the Consumer Code: "The action resulting from a lack of conformity is time-barred two years from the delivery of the goods."
- Article 1641 of the Civil Code: "The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for its intended use, or which so diminish that use that the buyer would not have acquired it, or would have given only a lower price, if he had known of them." Article 1648, paragraph 1 of the Civil Code: "The action resulting from latent defects must be brought by the buyer within two years from the discovery of the defect."
- Article L217-16 of the Consumer Code. "When the buyer requests the seller, during the term of the commercial warranty granted to them upon the purchase or repair of movable property, to carry out repairs covered by the warranty, any period of immobilization of at least seven days is added to the remaining term of the warranty. This period begins from the date of the buyer's request for intervention or the date the property in question is made available for repair, if this latter date is later than the request for intervention."
To assert their rights, the Customer must inform the Seller in writing ( or letter) of any non-conformity of the Products or the existence of hidden defects upon discovery. The Seller will refund, replace, or repair Products or parts under warranty deemed non-conforming or defective.
Return shipping costs will be reimbursed upon presentation of proof of payment.
Refunds, replacements, or repairs of Products deemed non-compliant or defective will be carried out as quickly as possible and no later than 14 days following the Seller's confirmation of the non-compliance or hidden defect. This refund may be issued via bank transfer or PayPal. The Seller shall not be held liable in the following cases:
- non-compliance with the legislation of the country in which the products are delivered, which is the Client's responsibility to verify,
- in case of misuse, use for professional purposes, negligence or lack of maintenance by the Customer, as well as in case of normal wear and tear of the Product, accident or force majeure.
- The photographs and graphics displayed on the website are not contractual and do not constitute a guarantee by the Seller. The Seller's warranty is, in any event, limited to the replacement or refund of non-conforming or defective Products.
ARTICLE 9 – PERSONAL DATA
The Customer is informed that the collection of their personal data is necessary for the sale of Products by the Seller and for their transmission to third parties for the purpose of delivering the Products. This personal data is collected solely for the performance of the sales contract.
9.1 Collection of personal data

Unless the Client expressly agrees, their personal data will not be used for advertising or marketing purposes.
9.5 Data retention period
The Seller will retain the data thus collected for a period of 5 years, covering the time of limitation of the applicable contractual civil liability.
9.6 Security and confidentiality
The Seller implements organizational, technical, software, and physical digital security measures to protect personal data against alteration, destruction, and unauthorized access. However, it should be noted that the Internet is not a completely secure environment, and the Seller cannot guarantee the security of the transmission or storage of information over the Internet.
9.7 Implementation of Customer and User Rights
In accordance with the regulations applicable to personal data, the Clients and users of the site www.minug.net have the following rights:

If the Client's request is refused, the refusal must be justified. The Client is informed that in the event of a refusal, they may file a complaint with the CNIL (3 Place de Fontenoy, 75007 Paris) or take legal action.

ARTICLE 10 – INTELLECTUAL PROPERTY
The content of the website www.minug.net is the property of the Seller and its partners and is protected by French and international intellectual property laws. Any reproduction, in whole or in part, of this content is strictly prohibited and may constitute an infringement.
